Terms of Use

These Terms of Use (“Terms”) govern access to and use of MotivePulse IQ at https://www.mymotivepulse.com, operated by Motive Corp (“we,” “us”). By creating an account or using the service, you agree to these Terms and our Privacy Policy.

1. The service

MotivePulse IQ is a software-as-a-service (SaaS) platform for local businesses, real estate professionals, and marketing agencies. Features may include review request tools, AI reply drafts, Service Recovery, scoring (e.g. Motive Score / Farm Score), property intelligence, Home Vision, and related workflows. Features and package availability may change; some modules are marked “Soon” or waitlisted until they ship.

2. Accounts and eligibility

• You must provide accurate account information and keep it current.
• You are responsible for activity under your account and for keeping credentials secure.
• If you invite teammates or clients, you confirm you are authorized to share workspace data with them.

3. Subscriptions and billing

Paid plans are billed according to the package and tier you select (e.g. Starter / Professional). Fees, taxes, and renewals are shown at checkout or in-product. Unless required by law or stated otherwise, fees are non-refundable once a billing period starts. We may suspend access for unpaid invoices or abuse.

4. Your data and content

You retain ownership of content you submit (business details, review lists, replies you approve, property addresses you look up, client notes, images, and similar). You grant us a limited license to host, process, and display that content solely to provide the service.

Agent- and customer-supplied data. Listing details, client criteria, CRM exports, and similar inputs come from you or your organization. You represent that you have the right to upload and use that data in MotivePulse IQ and that doing so does not violate MLS rules, brokerage policy, privacy law, or third-party rights.

5. Reviews and Google / Meta connections

• You may connect Google Business Profile or Meta only for locations or Pages you own or manage.
• AI reply drafts require your review. We do not auto-publish replies without your explicit approval in the product.
• Until Google Business Profile API posting is enabled for your account, approved replies may be stored for you to copy and paste into Google yourself. Do not assume one-click Google posting is live for every account.
• You remain responsible for the content of any reply or post published under your business identity.

6. AI-generated content (including Home Vision and reply drafts)

MotivePulse IQ uses artificial intelligence to suggest reply text, coaching tips, Home Vision imagery or concepts, and similar outputs. AI results can be incomplete, inaccurate, or inappropriate. You must review all AI output before using it with customers, on Google, in marketing, or in any professional context. We do not warrant that AI output is error-free, original for copyright purposes, or fit for a particular purpose.

7. Property intelligence — no MLS scrape claims

Property and neighborhood tools are designed around parcel and area signals (for example open municipal data, public scores, and information you enter). MotivePulse IQ does not claim to scrape MLS boards, CREA DDF, or broker IDX feeds unless and until a separate licensed integration is expressly enabled for your account. Do not upload or instruct the product to harvest MLS content in violation of board or CREA rules. Skip tracing and building private dossiers on individuals are not permitted uses.

8. Acceptable use

You agree not to:

• Violate law, platform policies (Google, Meta, etc.), or these Terms
• Attempt to access other customers’ data or disrupt the service
• Use the product to send spam or deceptive review solicitation
• Reverse engineer or resell the service except as we expressly allow
• Misrepresent AI-generated content as human-authored professional advice where disclosure is required

9. Intellectual property

MotivePulse IQ, Motive branding, and the software (excluding your content) are owned by Motive Corp or its licensors. These Terms do not transfer ownership of our IP to you.

10. Third-party services

Integrations (Google, Meta, payment processors, email, maps, AI providers, Walk Score® where shown, and similar) are subject to those providers’ terms. We are not responsible for outages or policy changes on third-party platforms.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee specific ranking, review volume, lead volume, or business outcomes.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTIVE CORP AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR CAD $100 IF YOU HAVE NOT PAID).

13. Indemnity

You will defend and indemnify Motive Corp against claims arising from your content, your use of the service, your review replies or marketing, or your violation of these Terms or third-party rights (including MLS / platform rules).

14. Termination

You may stop using the service at any time. We may suspend or terminate access for breach, risk, or non-payment. Provisions that by nature should survive (including IP, disclaimers, liability limits, and indemnity) survive termination.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law rules. Courts in Ontario have exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.

16. Changes

We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance, except where applicable law requires additional notice or consent.
